Problem on Ebay, not happy with purchase.?

I purchased and just received (today) a klein’s linemans pliers. It was listed as being new but it’s real obvious that it is not.. nicks in the handles, teeth are worn down a little.. What’s the best thing for me to do? The seller told me to send it back and he would fix the problem, but I kind of don’t want to because I don’t want to go another 1-2weeks without it and I don’t want to pay the shipping.

eBay has a policy against that kind of thing. Ask the seller if they’ll pay for the shipping and send a new one, and if they decline then report it to eBay.
